Mediation
Mediation is a structured negotiation process in which an independent person, known as a mediator, assists the parties to identify and assess options and negotiate an agreement to resolve their dispute. Mediation is an alternative to a judge imposing a decision on the parties.
Family Dispute Resolution(FDR)
Family Dispute Resolution (FDR) is a special type of mediation for helping separating families to come to their own agreements. During FDR families will discuss the issues in dispute and consider different options, while being encouraged to focus on the needs of their children.
Why Pick Mediation/FDR?
Time
a dispute can usually be resolved more quickly through mediation than through a trial.
Confidentiality
mediation is private. The judge is not informed of the content of the mediation, and the content cannot usually be used against a party if the case goes to trial. (It is recommended that you discuss mediation confidentiality with a lawyer.)
Cost
if a dispute can be resolved through mediation, the costs of preparing and running a trial can be avoided. Also, after a trial, the unsuccessful party may be ordered to pay the legal costs of the successful party.
Finality
settlement agreements can usually be modified only if all parties agree.
Stress
Testimonials show mediation is less formal and less intimidating than appearing in court case
Satisfaction
because you and the other party or parties decide and agree on the outcome of the dispute, you are more likely to be satisfied with the result and to comply with what has been agreed.
Flexibility
